Terms and Conditions

1. Purpose of the Service

Inizion Photo offers a service for the sale and distribution of high-resolution digital photo files. Images purchased on this platform are delivered in digital format without preview watermarks, and their use is strictly subject to the license described in Section 6 of this document.

2. Purchasing Process and Taxes

The price of each digital photograph is clearly displayed in the shopping cart. The prices shown on the website are in Euros (€) and include Value-Added Tax (VAT at 21%) applicable in Spain, or other applicable taxes.

To process an order, the customer must provide accurate billing information (Name, ID Number/Tax ID, Address). Upon confirming the purchase, a legal invoice will be generated, which the customer can download at any time from their Customer Area.

3. Payment Methods and Activation

Inizion Photo offers the following payment methods:

• PayPal / Credit Card: Payment is processed instantly through PayPal’s secure payment gateway. Order activation and delivery of the digital files occur immediately and automatically.
• Bank Transfer: The order will remain in “Pending” status. The customer must make the payment to the specified IBAN, indicating the Order Number. Access to the digital files will be manually enabled once Inizion Photo verifies receipt of the funds in its account (this may take 1 to 3 business days).

4. Delivery and Custody (Customer Services)

Once payment is approved, the original files will be available in the user’s private Client Area, which can be accessed using an email address and password. They can be downloaded individually or as a .ZIP file.

5. Return Policy and Waiver of the Right of Withdrawal

In accordance with Spain’s General Law for the Protection of Consumers and Users, consumers generally have a 14-day right of withdrawal. However, this regulation provides for exceptions.

According to Article 103(m) of said law, the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium once performance has begun. By checking the consent box during the purchase process, the user expressly requests immediate access to the digital photographs and acknowledges and accepts that, once the files are made available for download, they irrevocably lose their right of withdrawal or return.

6. Intellectual Property and License Agreement

The purchase of a digital photograph does not imply the transfer of copyright. Laura Salazar (Inizion Photo) is the sole and exclusive owner of the intellectual property rights to all images displayed on the platform, which are protected by Spanish intellectual property law.

Upon purchasing a file, the customer obtains a license for personal and private use. This means that the customer may:

• Download, print, and store the image strictly for personal use.
• Share the image on their personal social media accounts, always crediting or tagging Inizion Photo (@inizion.photo).

The following is strictly prohibited: Using the photograph for commercial, advertising, promotional, or profit-making purposes; drastically altering the original image; reselling, licensing, or transferring the image to third parties (brands, companies, media outlets) without the express written consent of Laura Salazar.

7. Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by applicable Spanish law. To resolve any conflict or dispute that may arise in connection with the interpretation or application of these terms and conditions, the parties expressly submit to the courts and tribunals of Madrid, waiving any other jurisdiction to which they may be entitled.
